Contract on Hotel Services
The limited liability company “ “PRAHA Uzh” represented by its director Popovych Vasyl Vasylovych who acts according to the Charter , hereinafter referred to as the Hotel , from the one hand ,and the Booking Person , hereinafter referred to as the Client, from the other hand , have concluded this Contract as follows :
1.Subject and the general provisions of the Contract.
1.1. The subject of the Contract is sale of the hotel services to the Client (individuals and a group of individuals ) by the Hotel.
1.2. Any acts a actions referred to the hotel services comply with the provisions of the Contract on Sale and Purchase.
2. Prices and terms and conditions for sale of the services.
2.1. The principal services provided by the Hotel are accommodation and breakfast.
2.2. The extra services as transfer, rent of the conference - hall, extra restaurant services, mini - bar, laundering, dry cleaning, telephone calls, sight tours, entertainment are covered by the Client either in cash or by credit card according to the Hotel rates.
2.3. The hotel rates are posted at the Hotel website .The prices not set in the website are charged in compliance with cl.2.2.
2.4. The Hotel is in position to change the Hotel rates. The booking made before the change of the rates is charged according to the initial rates.
2.5. The accommodation and payment at the hotel are effected as follows:
Check - out - 12.00 local time
Check - in - 14.00 local time
2.6. The rate for a whole day is charged in case the check - in is made till 6.00 a.m. morning.
2.7.The rate of a day is charged in case the check - in is made after 6.00 a.m. while the check -out is made at 12.00.
2.8. The check - in at 13.00 is deemed too early and not guaranteed but may be done would the free rooms are available.
2.9. Under the advance agreement with a hotel reception ( 24 hours in advance ) provided that there are free rooms the prolongation may be done under the following rates:
Departure by 14.00 - free of charge
Departure by 18.00 - 50% of rate per day
Departure after 18.00 - a full day rate
2.10. The charges for extra bed are the following:
Children up to 2 years old - free of charge
Children from 2 - 6 year old - 90 .00 UAH
Children 6 - 15 years old -120.00 UAH
Grown -ups - 200 UAH.
2.11. Payment by remittance is effected not later than five days before arrival.
2.12.Credit card payment: American Express, Visa International, MasterCard International. Information about the data the customer leaves on the site is confidential. The only information accessible to the hotel is about the result of transaction and the e-mail of the customer.
3. Hotel booking
3.1. Booking is deemed done only if the booking application in written form is submitted, faxed or e-mailed or it is made on-line not later than 3 (three) days before arrival.
3.2. Booking is deemed done provided that the Client has received a confirmation in the written form or electronic version thereof. Each on-line order is assured.
3.3. Booking made by telephone without relevant written confirmation of the Hotel is not guaranteed.
3.4. In case the Client fails to provide the required information in full about himself (to complete properly the form posted at the hotel website) or about accommodation (duration of staying, category, amount of persons) his/her application is not accepted.
3.5. The Booking Client has the following options for payment:
3.5.1. a credit card: when the process of reservation will be completed, the proper facilities will be written-off from your credit card.
3.5.2. remittance: upon receiving of the completed booking form the Hotel submits to the Client a bill (by fax or e-mail) for charging the booked period which is to be covered by a Client not later than 5 days prior to his/her arrival to the Hotel unless otherwise provided by the Contract.
4. Terms and Conditions for cancelation of booking
4.1. There are no booking charges.
4.2. Cancelation of booking made by individuals causes the following aftermaths:
4.3. the Client coming late but not more than 24 hours is to cover the whole booked period. Would the Client is late over 24 hours the booking is cancelled.
4.4. Cancelation made 48 hours prior to the arrival is deemed made in due time.
4.5. Cancelation made by 18.00 at the day of scheduled arrival is deemed overdue.
4.6. Would the cancellation is made overdue or the Client fails to come a fine is charged in the amount of a rate per day.
4.7. Ñancellation of the room booking for the groups entails the following aftermaths:
- 29 - 15 days prior to the arrival 30 % of the cost of the booked rooms for a day
- 15 - 5 days prior to the arrival 70 % of the cost of the booked rooms for a day
- 4 - 1 days prior to the arrival 100 % of the cost of the booked rooms for a day
5. Rights and obligations of the Hotel:
5.1. Rights and obligations of the Hotel:
5.1.1. The Hotel makes the booking in compliance with the dates fixed at the submitted application. As the Hotel has received the application it either confirms the booking or declines it. The Hotel confirmation submitted to the Client implies guarantee of the booked services.
5.2. The rights and obligations of the Client:
5.2.1. The Client submits the booking application not later than 3 (three) days before his arrival.
5.2.2. The Client is in position to cancel the booking or make any changes but only in the written form (or electronic version) not later than 2 (two) days before arrival (it is not referred to the groups.)
5.2.3. The Client covers the Hotel services in full and in time according to this Contract.
6. The terms and conditions of payment:
6.1.The full payment is to be made in the national currency of Ukraine - UAH according to the application and the bill drawn by the Hotel.
7. Force - majeure circumstances
7.1.No responsibility is borne for non-performance of the obligations caused by the circumstances not depended upon the Parties (war, natural calamities, government acts). The Parties are to notify the commencement of the above circumstances not later than 3 (three) days as they have come in effect. Such notification in written form is faxed or e-mailed. Would the force - majeure circumstances be in effect longer than a month the Parties are authorized to terminate the Contract.
8. Settlement of the disputes
8.1. In case the Client makes claims against the rendered services he/she has to file it in written form and submit the relevant confirmation thereof. Within 30 days the Hotel either compensates the losses or declines the claim by giving the justified explanation.
8.2. Any disputes which may arise out of this Contract are to be settled by negotiations, any disputes and discords which failed to be settled by negotiations are subject to the court trial.
9. Other conditions and terms
9.1. The exchange by the information and documents is to be made by facsimile, e-mail and other means of communication what makes it possible to establish the fact of sending and receiving thereof.
9.2. By making booking by on-line the Client agrees with the conditions of this Contract.
